This dissertation focuses on the topic of analyticity. The traditional concept of analyticity characterizes analytic sentences in at least two ways. On the one hand, these sentences are thought to be true in virtue only of the meaning of the expressions that constitute them. On the other hand, they are thought to be such that they can be concluded by competent speakers in an a priori fashion--that is, merely on the basis of the speakers' knowledge of the meaning of the (...) expressions contained in the sentences. In the dissertation I argue that these two ways of characterizing analyticity do not single out the same set of sentences, and that at least two different notions of meaning should be postulated to account for this fact. ;To show this I focus first on the notion of truth in virtue of meaning. I identify two ways in which a sentence can be said to be true in virtue of meaning: on the one hand, if the condition it expresses necessarily obtains; on the other hand, if semantic facts concerning the reference of the expressions that constitute it determine that it has to be true. I argue that the sets of sentences that can be said to be true in virtue of meaning according to these two criteria and the set of sentences ordinarily deemed analytically true do not coincide. ;I focus then on the second traditional criterion for analyticity--i.e., apriority. This criterion determines a set of sentences--what I call a priori acceptable sentences--that seems to coincide most closely with the set of sentences we ordinarily judge to be analytic. To account for the disparity between the extensions of this and the 'truth in virtue of meaning' criteria I propose that a distinction should be made between truth-conditional meaning--which concerns the contribution of expressions to truth-conditions--and conceptual meaning--which concerns the abilities necessary for competence in a language. I finally argue that conceptual meaning cannot always guarantee the truth of a priori acceptable sentences. (shrink)

The understanding of a wide array of practices related to fraud, bribery, corruption, and more widely, illicit practices have been capturing the attention of practitioners and management researchers worldwide. A substantial portion of the extant research has used university students to measure their actual or intended cheating behaviours and often studies have tested for variations across countries and cultures. We highlight some major concerns in this stream of inquiry and discuss both the definition and some inconclusive results in prior studies, (...) namely those deriving from differences in cheating behaviour across different cultural contexts. We suggest the need to examine intentionality, and further advance that intentionality may assume a reactive or a proactive essence. Depending on the social and formal contexts of different countries, both reactive and proactive intentions lead to distinct moral concerns, which we name in this work omorality (meaning ‘our morality’) or immorality (in the traditional sense). The aim of this paper is to focus on the phenomenon of selective attention as pointing out important psychological cases where it is arguable that we can have practical reasons without the capacity to carry out any relevant inference. Selective attention also would serve to show the possibility to have very basic demonstrative references to particular perceptual items without the possession of any concept. I will argue that if we assume 1) that believing can be taken as a kind of (...) action and 2) that demonstrative references to particular empirical items in that so basic sense have an important epistemological role in all of our knowledge, then our conclusions would have a very large application. There would be reasons without inferences not only for acting but also for believing, anddemonstrative reference without concepts would be an uneliminable component of our knowledge. (shrink)

In this paper, we analyze a way of valuing positively something which rarely has been taking into account in the literature: to value positively something because it could be valued positively by someone else. The main features of that way of valuing something are really very suggesting. Here, we would not have instrumental valuations, nor valuations directly sensitive to intrinsic values either. However, there would be cases in which valuations made in that way would make us able to detect things (...) that can be valued in an inconditional way. When we imagine or conceive what could be value positively, our motivational structures face us with something that is valued without evaluative conditions and, therefore, with something that is a good candidate to have an intrinsic value. A partir de dos poemas de Borges se emprende un análisis de la experiencia del instante, inicialmente al trasluz de la crítica hegeliana de la inmediatez sensible como decir inconsciente, para, después, trasponerla al vacío constitutivo de la identidad que destapa el deseo, empresa que conduce hasta un fenómeno del presente como diástasis que depara la presencia de la ausencia.

This bibliographical study involved first the exploitation of four data-banks: Medline, CNRS, Bioethics and AIDS, with the following key words (in conjunction with AIDS): ethics, human rights, confidentiality, legislation, jurisprudence. A total of 412 references were listed between 1983 and the end of 1987. Examination of the quantitative increase of articles over these years shows that, while references to AIDS and/or HIV infection--referred to as 'AIDS' for brevity--increased by about one third per year, the number of papers treating ethical problems (...) linked to AIDS doubled each year. This increase makes it clear that these problems are important and pressing, that they are evolving rapidly and can be given no easy solution. After reading and analysis of accessible articles in readily comprehensible languages, the different themes can be classified in two categories: 1: Measures intended to protect society (starting with the most coercive); quarantine and isolation; discriminatory measures concerning specific groups; non-respect of the confidential nature of medical information; application of the penal code; screening; obligatory declaration and registration; testing of blood given by donors; vaccination and medical innovations, therapeutic assays; information, education. 2. Measures intended to protect the individual: fundamental rights of the patient: his/her right to confidentiality, to information and to treatment; civil rights: civil liberty, right to education, right to work, etc...; rights of the healthy individual: right of those in contact with the patients, safety of hospital staff, of those receiving blood-transfusions, etc... The legislation adopted in the various countries and the main opinions to be found in these articles are listed and analysed, and for each particular theme it is possible to refer to a list of the 232 most important articles. While the debate seems to concentrate on the conflict between the right of society to protect itself against the spread of infection and the 'civil' rights of the infected minorities, our conclusion tends to reduce this antagonism, showing that, particularly as far as the confidential nature of medical information is concerned, measures intended to protect the individual also protect society. In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)

This chapter offers some insight into Spinoza's understanding of the concept of potentia. As is well known amongst scholars, the concept of potentia is fundamental for Spinoza. From ontology, to ethics and politics, the concept of potentia seems to embody the unity of Spinoza's thought. Unlike E1p9, Spinoza focuses on the independence or in the per se nature of the intelligibility of each attribute. The demonstration of the proposition recalls both the definition of the attribute and the definition of substance (...) as explanations. Having more reality, Spinoza states, means having more powers or strength, that is, more potentia to exist. The chapter shows that Spinoza's radical ontology of power emerges in the propositions preparing the consideration of God's necessary existence, namely E1p9–10. (shrink)

The author maintains in this article that it is possible an approach between the positivistic legal theory, the one that follows the model of the analytical theory developed by Hart, and those others that apply a socio-legal method. Against what some defenders of both perspectives advocate, who view each others with some disdain, the author asserts the need to integrate legal theory with social sciences in the field of juridical ideas. This supposes opening spaces to develop a socio-legal theory of (...) law that lives equally from categories of conceptual analysis and of sociological research. The author rests specially, in order to defend this position, on authors like Roger Coterrell, Denis Galligan, Nicola Lacey and, above all, Brian Tamanaha and William Twinning, whose arguments are here object of special consideration.
